Introduction to the Legal Department
Duties and Authorities:
The Office of Legal Affairs, Contracts, and Complaints at Quchan University of Advanced Technology performs its duties as follows to ensure the proper implementation of laws and regulations and to regulate legal relations with external entities, in a manner that protects public funds and the interests of the University:
Legal and Criminal Affairs
- Filing complaints and drafting indictments, reviewing and responding to criminal claims, opening cases in relevant court branches, following up through judicial authorities, police stations, etc., appointing representatives and attending scheduled court hearings, and pursuing cases until a final verdict is achieved, enforced, or appealed.
- Drafting civil petitions and submitting them to the competent judicial authority, along with preparing necessary documentation.
- Attending court hearings upon notification and staying informed of issued judgments and following up on their enforcement.
- Appealing judgments issued by judicial and quasi-judicial authorities.
- Reviewing and responding to civil lawsuits filed for or against the University, such as: damages, property eviction, claims for rental arrears, specific performance (compelling fulfillment of obligations), etc.
- Following up on cases in quasi-judicial bodies (Dispute Resolution Boards of the Ministry of Labor and Social Affairs, Social Security Organization, etc.).
- Handling registration/notarial affairs.
Contracts and Tenders
- Participating in meetings and supervising the university’s tender and auction procedures.
- Drafting contracts for various university units with natural and legal persons (including contracts for facilities, technical services, construction, civil engineering, services, food preparation and catering, transportation, procurement of supplies and equipment, educational/research/consulting services, lease agreements, and other contracts required by the University).
- Drafting contracts for project implementation while ensuring all legal and financial aspects are covered (strictly adhering to contract terms, general conditions of contracts, circulars, bylaws, and the general laws of the country).
- Drafting and amending addenda, revisions, and agreements related to contracts.
- Preparing and following up on transaction documents (formal/official and informal), such as procurement.
- Collaborating and coordinating with the University’s Financial Department regarding the financial aspects of contracts.
- Reviewing the amount and type of performance bonds and contract guarantees to ensure compliance with the University’s financial and transactional regulations.
- Revising and editing the terms and conditions of tenders and auctions for procedural execution.
- Drafting newspaper advertisements for tenders.
Other Matters
- Drafting and sending legal notices (statements) and responding to received legal notices.
- Responding to inquiries from various university units regarding contractual, employment, and other matters.
- Reviewing university bylaws and regulations.
- Performing other legal duties as assigned by superiors.
